Terms of Service

"Software" refers to RescuePC, including all versions, updates, and related tools.

"User" refers to any individual or entity using our software or services.

"License" refers to the limited, non-exclusive, non-transferable right to use the Software.

"Service" refers to all RescuePC services, including but not limited to software downloads, support, and updates.

Subject to these Terms, RescuePC grants you a limited, non-exclusive, non-transferable, revocable license to:

• Download and install the Software on devices you own or control
• Use the Software for its intended purpose
• Access updates and support services during your license period

This license does not grant you ownership of the Software or any intellectual property rights.

You may not:

• Reverse engineer, decompile, or disassemble the Software
• Modify, adapt, or create derivative works
• Distribute, sublicense, or transfer the Software
• Use the Software for illegal or unauthorized purposes
• Attempt to gain unauthorized access to our systems
• Use the Software to harm, damage, or interfere with other systems
• Remove or modify any copyright, trademark, or proprietary notices

THE SOFTWARE IS PROVIDED "AS IS" WITHOUT WARRANTIES OF ANY KIND.

RescuePC disclaims all warranties, express or implied, including but not limited to:

• Warranties of merchantability
• Warranties of fitness for a particular purpose
• Warranties of non-infringement
• Warranties that the Software will be error-free or uninterrupted

IN NO EVENT SHALL RESCUEPC BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOST PROFITS, DATA, OR BUSINESS OPPORTUNITIES.

If you access the Software under an evaluation or trial license, you may use it solely for non‑production evaluation purposes during the designated trial period. Evaluation licenses are provided “as is,” without uptime or performance warranties, and are not intended for regulated production use.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, RESCUEPC' TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNT PAID BY YOU FOR THE SOFTWARE IN THE 12 MONTHS PRECEDING THE CLAIM.

This limitation applies to all causes of action, whether in contract, tort, or otherwise.

You agree to indemnify, defend, and hold harmless RescuePC from and against any claims, damages, losses, and expenses arising from:

• Your use of the Software
• Your violation of these Terms
• Your violation of any third-party rights
• Any unauthorized use of the Software

Your license terminates automatically if you fail to comply with these Terms. Upon termination:

• You must cease all use of the Software
• You must destroy all copies of the Software
• All provisions of these Terms survive termination

These Terms are governed by the laws of the State of Delaware, United States, without regard to conflict of law principles.

Any disputes shall be resolved exclusively in the courts of Delaware, and you consent to personal jurisdiction.

If any provision of these Terms is held to be invalid or unenforceable, the remaining provisions shall continue in full force and effect.

These Terms constitute the entire agreement between you and RescuePC regarding the Software and supersede all prior agreements and understandings.
